Welcome to THE FRED NETWORK® — the online community for economists. THE FRED NETWORK® is owned and operated by the Federal Reserve Bank of St. Louis, One Federal Reserve Bank Plaza, P.O. Box 442, St. Louis, MO 63166-0442, USA (“Bank”).
By accessing, viewing, downloading or otherwise using THE FRED NETWORK® or any webpage, content or feature available through THE FRED NETWORK®, any information provided as part of THE FRED NETWORK®, or any related emails, newsletters or services (hereinafter collectively “FRED Network” or the “Services”), or by clicking “Signup” during the registration process, you signify that you have read, understand and agree to be bound by the FRED Network Terms of Use, which include:
- The terms and conditions set forth in this document;
- The Federal Reserve Bank of St. Louis web site Legal Terms
- The Federal Reserve Bank of St. Louis Privacy Policy; and
- Any additional guidelines and future modifications.
(Collectively, the above-listed documents comprise and are known as "Terms of Use") If you disagree with any of the Terms of Use, the Bank does not grant you a license to use the FRED Network.
Changes to Terms of Use
The Terms of Use may be amended only by a writing executed by the Bank and we reserve the right to update, modify or change the Terms of Use from time to time without notice. You understand and agree that your continued use of the FRED Network after the date on which the Terms of Use have changed constitutes your acceptance of the new Terms of Use. If a modification is unacceptable to you, you may terminate the agreement by ceasing use of the FRED Network. Although we may attempt to notify you when major changes are made to these Terms of Use, it is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use and to review such changes.
Eligibility
Membership in the FRED Network is void where prohibited. By using the FRED Network, you represent and warrant that you are eighteen (18) years of age or older, or an emancipated minor, or possess legal parental or guardian consent, and you have full power, capacity and authority to accept these Terms of Use, and to abide by and comply with these Terms of Use, and that you have not been previously suspended or removed from the FRED Network by Bank. In any event, you represent and warrant that you are over thirteen (13) years of age. The FRED Network is not intended for children under 13. Any registration by, use of or access to the FRED Network by anyone under 13, is a violation of these Terms of Use.
If you are accepting on behalf of your employer or another entity, you represent that you have full legal authority to bind your employer or such entity to these Terms of Use. If you don't have the legal authority to bind, please ensure that an authorized person from your employer or entity consents to and accepts these Terms of Use on behalf of your employer or entity.
Registration Data; Account Security
You agree to:
- provide true, accurate, current and complete information about you as may be prompted by any registration forms on the FRED Network ("Registration Data");
- maintain and promptly update the Registration Data, and any other information you provide to Bank, to keep it accurate, current and complete;
- have your personal data transferred to and processed in the United States.
- maintain the confidentiality and security of your password and identification; and
- be solely and fully responsible for all use of your account and for any actions that take place using your account. If you have reason to believe that your account is no longer secure (e.g., in the event of a loss, theft or unauthorized disclosure or use of your account ID, password, or any other personal information), then you agree to immediately notify Bank. You may be liable for the losses incurred by Bank or others due to any unauthorized use of your Fred Network account.
You agree not to:
- create an account for anyone other than yourself without permission;
- attempt to cloak or conceal your identity when registering to use or using the FRED Network.
- use the FRED Network if you are under 13;
- use the FRED Network if you are located in a country embargoed by the U.S., or are on the U.S. Treasury Department's list of Specially Designated Nationals;
- share your password, let anyone else access your account, or do anything else that might jeopardize the security of your account;
- transfer your account to anyone without first getting the Bank’s written permission.
Term and Termination
Your license to use the FRED Network under these Terms of Use continues until it is terminated by either party. Upon termination, you lose access to the FRED Network. These Terms of Use shall survive any termination.
- You may terminate your license, your account and these this Terms of Use by discontinuing use of the Fred Network.
- Bank may terminate your license, your account, or your use of the Fred Network (or any part thereof) and remove and discard all or any part of your Registration Data, User profile, or User Content at any time without prior notice for any or no reason and at its sole discretion.
- Your rights to use the FRED Network terminate automatically if (i) you violate any of these terms, (ii) Bank sends a written notice of termination to you, or (iii) Bank disables your access to the FRED Network.
- Bank may at any time may change, suspend, or discontinue the FRED Network or any part thereof, with or without notice.
- Bank may impose limits on certain features and services or restrict your access to parts or all of the FRED Network without notice or liability.
- Your only remedy with respect to any dissatisfaction with (i) the FRED Network, (ii) any term of this Terms of Use, (iii) any policy or practice of Bank in operating the FRED Network, or (iv) any content or information transmitted through the FRED Network, is to terminate this Terms of Use and your account.
Property Rights and License
All content on and available through the FRED Network, including visual interfaces, designs, text, graphics, pictures, video, information, compilation, applications, software, computer code (including source code or object code), music, sound and other files, and their selection and arrangement, and the trademarks, service marks and logos contained therein (the "Network Content"), except for any User Submissions as defined below that are provided and owned by Users, are the proprietary property of the Bank, its users or its licensors with all rights reserved. No Network Content may be modified, copied, distributed, framed, reproduced, republished, downloaded, scraped, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the Bank’s prior written permission, except that the foregoing does not apply to your own User Content (as defined below) that you legally post on the FRED Network.
Provided that you are eligible to use the FRED Network, you are granted a limited license to access and use the FRED Network and the Network Content and to download or print a copy of any portion of the Network Content to which you have properly gained access solely for your personal, non-commercial use, provided that you keep all copyright or other proprietary notices intact. Except for your own User Submissions, you may not upload or republish Network Content on any Internet, Intranet or Extranet site or incorporate the information in any other database or compilation, and any other use of the Network Content is strictly prohibited. Such license is subject to these Terms of Use and does not permit use of any data mining, robots, scraping or similar data gathering or extraction methods. Any use of the FRED Network or the Network Content other than as specifically authorized herein, without the prior written permission of Bank, is strictly prohibited and will terminate the license granted herein. Such unauthorized use may also violate applicable laws including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated herein, these Terms of Use grant you no right, title, or interest in any Network Content.
Bank Content
The FRED Network, all Network Content, and all intellectual property rights in and to the FRED Network and all Network Content are and shall at all times remain the sole and exclusive property of the Federal Reserve Bank of St. Louis and are protected by applicable intellectual property laws and treaties.
These Terms of Use grant you no right, title, or interest in any intellectual property owned or licensed by Bank. All rights not expressly granted to you are reserved by Bank.
Third Party Content
Data series available through the Bank’s web sites, including the FRED® and ALFRED® data series, may be owned by third parties and may be protected by copyrights, trademarks, service marks, international treaties, and/or other proprietary rights and laws of the U.S. and other countries. You agree to abide by all applicable proprietary rights laws and other laws, as well as any additional copyright notices or restrictions contained in the data series or these Terms of Use. Neither the Bank’s provision of the FRED Network to you nor your use of the FRED Network override the data series owners' copyrights, requirements and restrictions. You are solely responsible for complying with any requirements or restrictions imposed on usage of the data series by their respective owners.
The Federal Reserve Bank of St. Louis exercises no control over any content you or others submit while using the FRED Network. The Federal Reserve Bank of St. Louis has no obligation to verify the identity of any Users when they are connected to the site or to supervise the content which has been provided by Users.
Your User Submissions
- As the holder of a FRED Network account, you may submit content and comments, collectively referred to as "User Submissions." You understand and agree that User Submissions are non-confidential.
- You are solely responsible for your own User Submissions and the consequences of posting or publishing them. In connection with User Submissions, you affirm, represent, and/or warrant that:
- You own or have the necessary licenses, rights, consents, and permissions to use and authorize Bank to use all patent, trademark, trade secret, copyright or other proprietary rights in and to any and all User Submissions to enable inclusion and use of the User Submissions in the manner contemplated by the FRED Network and these Terms of Use.
- Your User Submission is not confidential and does not and will not: (a) infringe, violate, or misappropriate any third-party right, including any copyright, trademark, patent, trade secret, moral right, privacy right, right of publicity, or any other intellectual property or proprietary right; (b) slander, defame, or libel any other person; (c) violate any contractual restrictions or other third party rights; or (d) violate these Terms of Use; and
- Your User Submission does not contain any viruses, adware, spyware, worms, or other malicious code.
- You retain all of your ownership rights in your User Submissions. However, by submitting User Submissions to the FRED Network, you hereby grant the Federal Reserve Bank of St. Louis a worldwide, non-exclusive, royalty-free, sublicenseable and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the FRED Network and Bank's business, including without limitation for promoting and redistributing part or all of the FRED Network (and derivative works thereof) in any media formats and through any media channels without acknowledgment or compensation to you. You understand and agree that Bank may retain server copies of User Submissions that have been removed or deleted.
- By submitting User Submissions to the FRED Network, you also hereby grant each user of the FRED Network a non-exclusive license to access your User Submissions through the FRED Network, and to use, reproduce, distribute, display and perform such User Submissions as permitted through the functionality of the FRED Network and under these Terms of Service.
- The above licenses granted by you in User Submissions are perpetual and irrevocable.
- In connection with User Submissions, you further agree that you will not submit material that is copyrighted, protected by trade secret or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Bank all of the license rights granted herein.
- You further agree that you will not, in connection with User Submissions, submit material that is contrary to these Terms of Use, which may be updated from time to time, or contrary to applicable local, national, and international laws and regulations.
- Bank does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Bank expressly disclaims any and all liability in connection with User Submissions. Bank reserves the right to remove User Submissions without prior notice.
- Bank is not responsible for a User’s misuse or misappropriation of any content or information you post
Your Use of Content on the Site
The following restrictions and conditions apply specifically to your use of content on the FRED Network.
- You agree to not engage in the use, copying, or distribution of any of the content of the FRED Network other than expressly permitted herein, including any use, copying, or distribution of User Submissions of third parties obtained through the Website for any commercial purposes.
- You agree not to circumvent, disable or otherwise interfere with security-related features of the FRED Network or features that prevent or restrict use or copying of any content or enforce limitations on use of the FRED Network or the content therein.
- You understand that when using the FRED Network, you will be exposed to User Submissions from a variety of sources. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable. Bank is not responsible for the accuracy, usefulness, safety, appropriateness, or intellectual property rights of or relating to such User Submissions.
- The FRED Network may contain links to third party websites that are not owned or controlled by Bank. Bank has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party websites.
- You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against the FRED Network with respect to third party content or sites, and agree to indemnify and hold the Bank, its officers, employees and agents, harmless to the fullest extent allowed by law regarding all matters related to your use of the FRED Network.
- You are solely responsible for your interactions with other FRED Network users. We reserve the right, but have no obligation, to monitor disputes between you and other users.
Digital Millennium Copyright Act
Bank undertakes to obey all relevant copyright laws, and does not permit copyright infringing activities and infringement of intellectual property rights on the FRED Network. Bank will review all claims of copyright infringement received and remove content deemed to have been posted or distributed in violation of any such laws.
Bank will promptly terminate without notice any User's access to the FRED Network if that User is determined by Bank to be a "repeat infringer." A repeat infringer is a User who has been notified by Bank of infringing activity violations more than twice and/or who has had their User Submission or any other user-submitted content removed from the the FRED Network more than twice. Bank may also at its sole discretion limit access to the FRED Network and/or terminate the memberships of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
- If you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):
- A physical or electronic signature of the copyright owner or the person authorized to act on its behalf;
- A description of the copyrighted work claimed to have been infringed; or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;
- A description of the infringing material and information reasonably sufficient to permit the Federal Reserve Bank of St. Louis to locate the material;
- Your contact information, including your address, telephone number, and email;
- A statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement that the information in the notification is accurate, and, under the pains and penalties of perjury, that you are authorized to act on behalf of the copyright owner.
- If you believe that your User Submission that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your User Submission, you may send a counter-notice containing the following information:
- Your physical or electronic signature;
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
- A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
- Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in St. Louis, Missouri, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.
If a counter-notice is received by Bank, Bank may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Bank's sole discretion.
- Claims and counter-notices can be sent to webaster@research.stlouisfed.org or Public Affairs, Federal Reserve Bank of St. Louis, P.O. Box 442, St. Louis, MO 63166-0442. You acknowledge that if you fail to comply with all of the above requirements of this Section, your DMCA notice or counter-notice may not be valid.
Prohibitions
You may not:
- Use the FRED Network in a manner that adversely impacts the stability, or in any other manner that could damage, disable, overburden or impair of the FRED Network or Bank servers;
- Upload, post, transmit, share, store or otherwise make available any content, or use the FRED Network for any application, product, service, or material that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable.;
- Upload, post, transmit, share, store or otherwise make available any content, or use the FRED Network for any application, product, service, or material or that constitutes, promotes or is used in connection with: spyware, adware, viruses, worms, defects, Trojan horses, or other malicious programs or code, counterfeit goods, items subject to U.S. embargo, unsolicited mass distribution of email ("spam"), multi-level marketing proposals, "chain letters," "pyramid schemes," or any other form of solicitation hacking, surveillance, interception, descrambling equipment, prostitution, body parts and bodily fluids, stolen products and items used for theft, fireworks, explosives, and hazardous materials, government IDs, police items, gambling, professional services regulated by state licensing regimes, non-transferable items such as airline tickets or event tickets, weapons and accessories;
- Harvest or collect email addresses or other contact information of other users from the FRED Network by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications;
- Use the FRED Network in any manner or for any purpose that violates any law or regulation, any right of any person, including but not limited to intellectual property rights, rights of privacy, or rights of personality;
- Upload, post, transmit, share, store or otherwise make publicly available on the FRED Network any private information of any third party, including, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers;
- Solicit passwords or personally identifying information for commercial or unlawful purposes;
- Use automated scripts to collect information from or otherwise interact with the FRED Network;
- Use the Federal Reserve Bank of St. Louis logo or any trademark, service mark, trade name or any other mark of Bank. No rights or licenses are granted except as expressly and unambiguously set forth herein;
- Remove, obscure, or alter any proprietary rights notices (including copyright and trademark notices) that may be affixed to content accessed or provided through the FRED Network;
- Use or attempt to use another's account, service or system without authorization, create a false identity, impersonate another user, or falsely claim an affiliation with any person or entity.
- Use the FRED Network for any commercial use without the prior written consent of Bank.
Bank reserves the right to decide whether a User Submission is appropriate and complies with these Terms of Use. Bank may remove User Submissions and/or terminate a user's access for uploading material in violation of these Terms of Use at any time, without prior notice and at its sole discretion.
Any suspected fraudulent, abusive or illegal activity may be referred to appropriate law enforcement authorities. These remedies are in addition to any other remedies Bank may have at law or in equity.
Support
Bank may elect to provide you with support for the FRED Network, in its sole discretion, and may terminate such support at any time without notice to you. This Agreement does not entitle you to any support for the FRED Network.
Disclaimer
SOME OF THE FRED NETWORK® MAY BE EXPERIMENTAL AND NOT TESTED IN ANY MANNER. BANK DOES NOT REPRESENT OR WARRANT THAT THE FRED NETWORK IS FREE OF INACCURACIES, ERRORS, BUGS, OR INTERRUPTIONS, OR IS RELIABLE, ACCURATE, COMPLETE, OR OTHERWISE VALID.
THE FRED NETWORK IS PROVIDED "AS IS" WITH NO WARRANTY, EXPRESS OR IMPLIED, OF ANY KIND AND BANK EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES AND CONDITIONS, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AVAILABLILTIY, SECURITY, TITLE AND/OR NON-INFRINGEMENT.
YOUR USE OF THE FRED NETWORK IS AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS FROM THE USE OF THE FRED NETWORK INCLUDING, BUT NOT LIMITED TO, ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA.
Limitation of Liability
BANK SHALL NOT, UNDER ANY CIRCUMSTANCES, BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH USE OF THE FRED NETWORK, WHETHER BASED ON BREACH OF CONTRACT, BREACH OF WARRANTY, TORT (INCLUDING NEGLIGENCE, PRODUCT LIABILITY OR OTHERWISE) OR OTHER LEGAL OR EQUITABLE THEORY, FOR ANY LOST PROFITS, LOST OR CORRUPTED DATA, COMPUTER FAILURE OR MALFUNCTION, INTERRUPTION OF BUSINESS, OR OTHER SPECIAL, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, OR ANY OTHER PECUNIARY LOSS OF ANY KIND ARISING OUT OF THE USE OR INABILITY TO USE THE FRED NETWORK, EVEN IF BANK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES AND WHETHER OR NOT SUCH LOSS OR DAMAGES ARE FORESEEABLE. UNDER NO CIRCUMSTANCES SHALL BANK BE LIABLE TO YOU FOR ANY AMOUNT.
Exclusions and Limitations
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS LIABILITY AND DISCLAIMERS MAY NOT APPLY TO YOU.
Release and Waiver
To the maximum extent permitted by applicable law, you hereby release and waive all claims against the Federal Reserve Bank of St. Louis, and its officers, agents, and employees from any and all liability for claims, damages (actual and/or consequential), costs and expenses (including litigation costs and attorneys' fees) of every kind and nature, arising from or in any way related to your use of the FRED Network . If you are a California resident, you waive your rights under California Civil Code § 1542, which states, "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor." You understand that any fact relating to any matter covered by this release may be found to be other than now believed to be true and you accept and assume the risk of such possible differences in fact. In addition, you expressly waive and relinquish any and all rights and benefits which you may have under any other state or federal statute or common law principle of similar effect, to the fullest extent permitted by law.
Hold Harmless and Indemnity
You agree that Bank shall have no liability whatsoever for any use you make of the FRED Network. You agree to indemnify and hold harmless Bank and its officers, agents, and employees from and against any and all claims, damages, liabilities, costs and fees (including reasonable attorneys' fees) arising from or in any way related to your use of the FRED Network, including any liability or expense arising from all claims, losses, damages (actual and/or consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.
Relationship of the Parties
Notwithstanding any provision hereof, for all purposes of the Terms of Use, you and Bank shall be and act independently and not as partner, joint venturer, agent, employee or employer of the other. You shall not have any authority to assume or create any obligation for or on behalf of the Bank, express or implied, and you shall not attempt to bind the Bank to any contract.
Invalidity of Specific Terms
If any provision of the Terms of Use is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision and the other provisions of such documents remain in full force and effect.
Location of Lawsuit and Choice of Law
The Terms of Use and the relationship between you and Bank shall be governed by the laws of the State of Missouri without regard to its conflict of law provisions or the United Nations Conventions for the International Sale of Goods. The exclusive venue and jurisdiction of any dispute or suit arising between the parties hereto shall be the Federal District Court for the Eastern District of Missouri, each party irrevocably submits to the jurisdiction and venue of any such court in any such action or proceeding.
No Waiver of Rights
Bank's failure to exercise or enforce any right or provision of the Terms of Use shall not constitute a waiver of such right or provision.
Miscellaneous
The section headings and subheadings contained in this Terms of Use are included for convenience only, and shall not limit or otherwise affect the terms of the Terms of Use. Any construction or interpretation to be made of the Terms of Use shall not be construed against the drafter. The Terms of Use constitute the entire agreement between Bank and you with respect to the subject matter hereof.
